Welcome to KiteToGo. These Terms of Service ("Terms") govern your use of our WhatsApp-based connection service for kitesurfing equipment rental. By using our service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using KiteToGo's services through WhatsApp, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not use our service.

You must be at least 16 years old to use this service. By using KiteToGo, you represent and warrant that you meet this age requirement.

2. Description of Service

KiteToGo is a connection platform that helps kitesurfing equipment owners connect with people looking to rent equipment through WhatsApp Business.

IMPORTANT: KiteToGo acts solely as a connection service. We:

DO: Facilitate connections between equipment owners and potential renters via WhatsApp
DO NOT: Own, sell, rent, or provide any kitesurfing equipment
DO NOT: Process payments or handle financial transactions
DO NOT: Verify, inspect, or guarantee the quality, safety, or condition of any equipment
DO NOT: Control or supervise rental agreements, pricing, or terms between users

All rental agreements, payments, insurance, equipment condition, safety, and liability matters are solely between the equipment owner and the renter. KiteToGo is not a party to any rental transaction.

3. User Accounts and Registration

To use KiteToGo, you must:

Have a valid WhatsApp account and phone number
Provide accurate contact information when requested
Be at least 16 years of age
Comply with these Terms and all applicable laws

4. User Responsibilities

All users agree to:

Provide accurate and truthful information
Communicate respectfully with other users
Comply with all applicable laws and regulations
Not use the service for fraudulent, illegal, or harmful purposes
Not harass, threaten, or intimidate other users
Negotiate all rental terms, conditions, and payments directly with other users
Conduct their own due diligence before entering into any rental agreement

5. No Liability for User Transactions

IMPORTANT DISCLAIMER: KiteToGo is not responsible for any aspect of rental transactions between users.

You acknowledge and agree that:

All rental agreements are made directly between equipment owners and renters
KiteToGo does not verify the identity, credentials, or representations of any user
KiteToGo does not inspect, test, or verify the safety or condition of any equipment
Users are solely responsible for assessing the suitability and safety of any equipment
Users must negotiate and agree upon all terms including pricing, duration, insurance, deposits, and liability
KiteToGo is not involved in and has no control over payment arrangements between users
Any disputes between users must be resolved directly between the parties involved

6. Safety Warning

WARNING: Kitesurfing is an inherently dangerous activity that carries significant risk of serious injury or death. You participate in kitesurfing activities entirely at your own risk.

You acknowledge that:

KiteToGo makes no representations about the safety of any equipment or user
It is your sole responsibility to inspect equipment before use
You must ensure equipment is appropriate for your skill level and conditions
You should obtain proper training, certification, and insurance before participating in kitesurfing
You are solely responsible for your own safety and the safety of others

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

KiteToGo provides the connection service "AS IS" without any warranties of any kind
KiteToGo shall not be liable for any injuries, damages, losses, or claims arising from equipment rentals or kitesurfing activities
KiteToGo is not responsible for the actions, omissions, or conduct of any user
KiteToGo is not liable for any disputes, damages, or losses between users
KiteToGo's total liability for any claim shall not exceed $100 USD
KiteToGo is not responsible for the accuracy, reliability, or availability of information provided by users

8. Indemnification

You agree to indemnify, defend, and hold harmless KiteToGo and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use of the service
Any rental transaction you enter into through the service
Any equipment you own, list, rent, or use
Your violation of these Terms or any applicable laws
Any injuries or damages to yourself or third parties
Your interactions with other users

9. Prohibited Conduct

You agree not to:

Use the service for any illegal purposes
Harass, threaten, or defraud other users
Impersonate any person or entity
Interfere with or disrupt the service
Use automated systems or bots to access the service
Collect user information without consent
Violate any applicable laws or regulations

10. Intellectual Property

KiteToGo and its licensors own all rights, title, and interest in the service, including all intellectual property rights. You may not copy, modify, distribute, or create derivative works based on the service without our prior written consent.

11. WhatsApp Business Integration

Our service operates through WhatsApp Business, which is provided by Meta Platforms, Inc. Your use of WhatsApp is subject to WhatsApp's Terms of Service and Privacy Policy. By using our service, you acknowledge that:

WhatsApp's terms and policies apply to all communications
Message delivery depends on WhatsApp's infrastructure
You can opt out by blocking our WhatsApp Business account
We communicate with you through the WhatsApp Business API

12. Termination

We reserve the right to suspend or terminate your access to the service at any time, with or without cause or notice. You may stop using the service at any time by blocking our WhatsApp Business account.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms and updating the "Effective Date" at the top of this page. Your continued use of the service after changes become effective constitutes acceptance of the revised Terms.

14. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes between users must be resolved directly between the parties. If you have a dispute with KiteToGo, you agree to first contact us to attempt to resolve the issue informally.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and KiteToGo regarding the service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

15.3 No Endorsement

KiteToGo does not endorse any user, equipment, or transaction. We make no representations about the reliability, safety, or quality of any user or equipment.

15.4 Independent Contractors

Users are independent contractors. No agency, partnership, joint venture, or employment relationship exists between users and KiteToGo.
